Following the most serious confrontation between Kosovo and Serbia in recent years, Europe's press is debating the future of the region. Vízi közlekedés halálos tömegszerencsétlenséget okozó gondatlan veszélyeztetésének vétsége miatt első fokon 5 év 6 hónap fogházban letöltendő szabadságvesztésre ítélte a Pesti Központi Kerületi Bíróság Jurij Csaplinszkijt, a Hableány katasztrófáját okozó Viking Sigyn kapitányát. Az ítélet nem jogerős.

A Hableány sétahajó 2019. május 29-én süllyedt el Budapesten, a Margit híd közelében, miután összeütközött a Viking Sigyn szállodahajóval. A Hableányon 35-en utaztak, 33 dél-koreai turista és a kéttagú magyar személyzet. Hét turistát sikerült kimenteni, 27 áldozat holttestét megtalálták, egy dél-koreai utast továbbra is eltűntként tartanak nyilván. Az ügyészség a Viking Sigyn szállodahajó ukrán kapitányát tette felelőssé a tragédiáért. A férfival szemben 2019 novemberében emeltek vádat vízi közlekedés halálos tömegszerencsétlenséget okozó gondatlan veszélyeztetésének vétsége és segítségnyújtás elmulasztásának bűntette miatt.

A segítségnyújtás elmulasztását nem állapította meg a bíróság.

A vádlott az utolsó szó jogán úgy fogalmazott, hogy nagyon nehéz a lelke, amikor felidézi magában a szörnyű tragédiát, amely annyi ártatlan áldozatot követelt. Az emlékek egy percre sem hagyják nyugodni, és a történtek az élete végéig elkísérik – tette hozzá. Hangsúlyozta, hogy végtelenül sajnálja a történteket, végül pedig kifejezte együttérzését az elhunytak hozzátartozóinak.

Indoklásában a bíró felidézte: a vádlott korábban azt vallotta, hogy a zuhogó esőben és az esti látási viszonyok között nem vette észre a Hableányt, és az ütközéskor is csak egy kisebb zökkenést érzékelt, amelyről azt gondolta, hogy csupán egy uszadék került a hajó alá. A bíróság szerint viszont a hajó kapitányának felelőssége, hogy adott látási viszonyok között elindul-e a járművével. A közlekedéshez szükséges eszközök – a többi között radar – rendelkezésre álltak a hajón.

A Hableány óránkénti hét-nyolc kilométeres sebességgel haladt, a Viking Sigyn pedig, miután a Parlament előtt óránkénti egy-két kilométeres sebességre lassított, felgyorsított óránkénti tíz-tizenegy kilométeres sebességre, így került előzési helyzetbe. Ugyanakkor, mivel a kapitánynak nem is állt szándékában az előzés, nem tartotta be az előzés szabályait. Nem adott hangjelzést, nem győződött meg az oldaltávolságról, valamint nem vette fel a kapcsolatot a másik járművel. Vagyis a baleset a kellő körültekintés és figyelem hiányára vezethető vissza – jelentette ki a bíró. A Hableányon eggyel kevesebb matróz volt, mint amennyi az előírásokban szerepel, így nem közlekedhetett volna. A szállodahajónak ennek ellenére meg kellett volna adnia az elsőbbséget a Hableánynak.

A 35 rendbeli segítségnyújtás elmulasztását azért nem állapította meg a bíróság – folytatta -, mert azt csak tudatosan, szándékos mulasztással lehet elkövetni.

A Hableány 30 másodpercen belül elsüllyedt. A vádlott a szállodahajón jajveszékelő utasokon kívül mást nem látott, és amikor rájött, hogy mi történhetett, azonnal vészjelzést adott le, a hajót biztosította, rádión bejelentést tett, továbbá meggyőződött arról, hogy a mentés megkezdődött. Azt sem lehetett bizonyítani, ténylegesen hány ember volt abban a helyzetben, hogy a vádlott segítséget nyújthatott volna nekik, és hány olyan bajbajutott volt, akin már semmiképpen nem lehetett segíteni – sorolta. Ezért bizonyítottság hiányában a tanácsvezető bíró felmentette a vádlottat a segítségnyújtás elmulasztásának vádja alól.

A bíró arról is szólt, hogy a büntetési tétel ebben az esetben kettőtől nyolc évig terjedő szabadságvesztés. Súlyosbító körülmény a sok elveszett emberélet és a jelentős anyagi kár, enyhítő körülmény a vádlott büntetlen előélete és megromlott egészségi állapota, a hosszú makulátlan hajóskapitányi gyakorlat, az idő múlása. A bíróság az elsőfokú ítéletben a vádlottat hat évre eltiltotta a vízi közlekedéstől is, valamint úgy rendelkezett, hogy az ukrán kapitány a büntetés kétharmadának letöltése után kerülhet feltételesen szabadságra.

Az ítélet nem jogerős. Az ügyészség arra kéri a másodfokú bíróságot, hogy állapítsa meg a vádlott terhére a 35 rendbeli segítségnyújtás elmulasztását is, halmazati büntetésként az ítéletben szereplőnél hosszabb és börtönben letöltendő szabadságvesztést szabjon ki. Indítványozták a letartóztatását is. A vádlott és védője felmentésért, illetve enyhítésért fellebbezett.

The OSCE Office for Democratic Institutions and Human Rights (ODIHR) today opened an observation mission for the 5 November local elections in Moldova, following an invitation from the national authorities.

The mission is led by Corien Jonker and consists of a core team of 11 experts based in Chişinău. ODIHR has requested 28 long-term observers from OSCE participating States, who will be deployed throughout the country from 6 October. ODIHR also plans to request 200 short-term observers, to arrive several days before election day.

The mission will assess the local elections for their compliance with OSCE commitments and other international obligations and standards for democratic elections, as well as with national legislation. 

Observers will closely monitor the work of the election administration and relevant government bodies, campaign activities, including in the media and social networks, and the resolution of election-related disputes. They will closely follow the implementation of the newly-introduced electoral code, as well as assessing the implementation of the previous ODIHR election recommendations.

To assess pre-election activities in the country, the mission will hold meetings with representatives of state authorities, political parties and candidates, civil society, the media and the international community.

On election day, the ODIHR mission will join efforts with delegations from the Congress of Local and Regional Authorities of the Council of Europe and the European Parliament to observe the opening of polling stations, voting, the counting of votes and the tabulation of results.

An interim report will be published some two weeks before the elections to update the public and media during the course of the observation. The day after the elections, the mission’s preliminary findings and conclusions will be presented at a press conference. A final report assessing the entire election process and containing recommendations will be published some months after the end of the election process. 

The ODIHR Election Observation Mission and the OSCE Mission to Moldova operate independently under separate mandates.

From 26 to 28 September 2023, the OSCE Presence in Albania organized a peer exchange visit for a delegation of the National Bureau of Investigation (NBI) to Romania with the aim of establishing co-operation and exchange experiences and best practices with regional law enforcement agencies.

The delegation led by NBI Director Aida Veizaj met with the Romanian Directorate for Investigating Organized Crime and Terrorism, the National Anticorruption Directorate and the Southeast European Law Enforcement Center.  

The Director of the NBI and her counterparts in Romania emphasized that co-operation, continuous exchange of information and joint investigations between the law enforcement agencies of the two countries are essential in the fight against organized crime, corruption and terrorism, which have extended beyond borders.

The OSCE Presence will continue to assist Albania’s National Bureau of Investigation in building capacities, and the efficient consolidation of its functioning.

On 28 September in Belgrade, seven participants of the 2023 Professional Practice Programme for young professionals from south and southwest Serbia received certificates of completion and presented the projects they designed and implemented during their 10-month professional placement with central institutions in Serbia.

For the fourth consecutive year, the Professional Practice Programme provided young men and women from south and southwest Serbia with an opportunity to gain first-hand professional experience in the civil service and improve their understanding of the functioning of Serbia’s democratic institutions. The Programme is implemented by the OSCE Mission to Serbia in partnership with the Ministry of Human and Minority Rights and Social Dialogue.

“This programme is unique in Serbia.  It connects young professionals from under-represented communities with central institutions: The participants learn about Serbia’s reform agenda and how it is implemented in practice. Institutions commit to fostering youth participation and learning about democratic governance, which the young women and men will hopefully bring home to their communities and apply in their future professional careers,” said Head of the OSCE Mission to Serbia, Ambassador Jan Braathu.

Throughout the 10-month placement period, the OSCE Mission to Serbia provided participants with a series of training seminars in the area of the rule of law, democratic governance, and project management. The seminars also integrated youth and gender perspectives, providing young people with skills and knowledge to support them in their pursuit of a career in the public sector.

The participants of the 2023 cycle completed their placements at the Office of the Commissioner for Protection of Equality, the Office of Public Procurement, the Ministry of Public Administration and Local Self-Government, the Ministry of Human and Minority Rights and Social Dialogue, the National Assembly of the Republic of Serbia, and the Coordination Body for the municipalities of Preševo, Bujanovac and Medveđa.

This year’s cycle was implemented with the support of the Permanent Missions of Norway, the Republic of Türkiye, and Poland to the OSCE.

EDA Chief Executive, Jiří Šedivý, visited Ireland for high-level talks with Micheál Martin, Tánaiste (Deputy Prime Minister) and Minister of Defence, and senior officials from the Irish Department of Defence.  The Chief Executive also met with members of the Irish Defence & Security Association. The trip to Dublin was part of Mr Šedivý’s ‘tour des capitales’, which sees him visiting all the EDA’s Member States.

The discussions with Minister Martin mainly focused on Ireland’s ongoing and increased involvement in EDA’s activities, new opportunities for EDA to support Irish defence efforts and the upcoming EU Capability Development Plan (CDP). Mr Šedivý also met with senior officials from the Irish Department of Defence, including; Secretary General Department of Defence, Jacqui Mc Crum, Defence Policy Director, Bernie Maguire and Capability and National Armament Director, Eamon Murtagh.  During the second day of the visit, the Chief Executive also held discussions with senior Irish Defence Forces’ personnel, Col Matt Byrne, Director of Ordnance and Lt Col Fred O Donovan, Strategic Planning Branch. 

To date, Ireland participates in a total of 11 EDA projects and programmes. These include: the European Centre for Manual Neutralisation Capabilities; the EU SatCom market; Military Search Capacity Building and MARSUR Networking. Ireland also signed EDA’s recent collaborative procurement projects for ammunition, CBRN and soldier equipment, and is awaiting acceptance into the MICNET projects, as part for a recent government decision to join four projects within the Agency.   Ireland also participates in four projects under the Permanent Structured Cooperation mechanism, PESCO, and is an observer in 21 projects.

“My visit to Dublin is particularly important as the cooperation between the Agency and Ireland has been growing. Over the past few years, Irish participation and interest in the EDA has only increased and I believe there are further opportunities ahead to deepen the Agency’s support to Ireland. The recent signature by Ireland to join EDA’s ambitious collaborative procurement projects is a testament to EDA’s tailored support on offer to all its Member States”, Jiří Šedivý said.  

“I very much welcome the Chief Executive of the European Defence Agency to Dublin.  Ireland has been a participating member of the Agency since its establishment in 2004.  We work closely with the EDA to enable the delivery of key capabilities for the Defence Forces.  Engagement in EDA Projects allows access to training, information sharing and key technologies that we simply would not be able to achieve on our own.  Ireland will continue to use all opportunities to enhance and develop Defence Forces capabilities through the EDA”, Micheál Martin, Tánaiste and Minister of Defence said. 

EDA’s wider role 

EDA supports all EU Member States in improving their defence capabilities through European cooperation. Acting as an enabler and facilitator for Ministries of Defence willing to engage in collaborative capability projects, the Agency has become the hub for European defence cooperation with expertise and networks spanning the whole spectrum of defence capabilities.
