Az Európa Tanács (ET) tagállamainak nem szabad megengedniük, hogy személyi biztonságukat garantáló intézkedések nélkül menekülteket toloncoljanak vissza a határaikon kívülre, ez a gyakorlat ugyanis az emberi jogok megsértésének számít, nem szabad törvényessé tenni – jelentette ki a strasbourgi székhelyű ET emberi jogi biztosa.

Dunja Mijatovic közleményében leszögezte: az Európa Tanács határozottan ellenzi a bevándorlók és menekültek menedékjoghoz való hozzáférésének megtagadását és biztosítékok nélküli – sőt akár erőszakkal kísért – visszatoloncolását az ET-tagállamok határain kívülre.

A jogellenes intézkedések legalizálására irányuló kísérletek, ahogy a biztonsági biztosítékok nélküli visszatoloncolások, aláássák az emberi jogok menekültügyi egyezményében megállapított jogi garanciákat, és sértik a kínzás, az embertelen vagy megalázó bánásmód, valamint a kollektív kiutasítás tilalmát – foglalt állást.

“Itt az ideje, hogy a kormányok véget vessenek azoknak a jogalkotási kezdeményezéseknek és politikáknak, melyek kísérletet tesznek a visszatoloncolások normalizálására, felszámolva ezzel a menekültek, menedékkérők és bevándorlók jogi biztosítékait a határokon” – fogalmazott.

Különösen fontos ez akkor, amikor az Európai Unió számos tagállama közösen sürgeti a meglévő szabályozás hozzáigazítását a megváltozott migrációs helyzethez – hívta fel a figyelmet. Noha több tagállam súlyos migrációs problémákkal küzd, vissza kell utasítani azokat a javaslatokat, melyek az európai határok védelmére hivatkozva félredobnának vagy válogatnának a szabályozás kulcsfontosságú emberi jogi védelemre vonatkozó fejezetei közül – jelentette ki.

Foglalkozni kell a tagállamok közötti szolidaritás hiányával, az erőteljes nyomás ugyanis a migránsok visszatoloncolásra ösztönzi az érkezési országokat – tette hozzá az Európa Tanács emberi jogi biztosa.
